EU Blue Card

The EU Blue Card allows non-EU citizens to reside and work in Spain or any EU country as highly qualified professionals, with additional benefits such as family reunification, mobility within the European Union, and preferential access to long-term residency.

What is the EU Blue Card?

The European Union Blue Card is a residence and work permit for non-EU citizens who wish to pursue highly qualified professional activity in a member country.

Its validity extends to all States of the Union, except Denmark and Ireland.

This figure was established by Directive 2009/50/EC and updated by Directive (EU) 2021/1883, with the aim of promote the attraction of international talent y respond to the need for qualified professionals in strategic sectors.

Requirements for obtaining a blue card in Spain

It is necessary to have a higher education degree (university or similar training). Failing this, the qualification can be accredited by at least three years of professional experience o five years of acquired skills and competencies, provided that they can be considered equivalent to that training.

A must be submitted signed employment contract or a firm job offer for a position requiring high qualifications, with a minimum duration of six months.

The contract must comply with the working conditions provided for in the applicable collective agreement, as well as the salary offered cannot be lower to the threshold set by the regulations, which must be between 1,0 and 1,6 times the average annual gross salary in Spain.

Request for authorization from the employer

Both the employer and the employee must participate in the application process, and the process can be initiated from the country of origin or within Spain.

Typically, the contracting company initiates the process by submitting the application for a residence and work permit to one of the following agencies:

  • The Large Companies and Strategic Groups Unit (UGE-CE).

  • The General Directorate of Migration, if the company has more than 500 employees and a presence in more than one province.

  • The competent Immigration Office, depending on the location of the work center.

What documentation must be provided?

To process the application, the following documents must be submitted:

  • Company NIF: Document that proves the tax identity and legal existence of the employing entity.

  • Identification of the legal representative: Proof of the person authorized to act on behalf of the company.

  • Form EX-05: Official form, correctly completed and signed.

  • Work contract: Copy signed by both parties, valid for a minimum of six months and in accordance with the current legal framework.

  • Certificates of tax and labor compliance: They demonstrate that the company is up to date with its payments to the Treasury and Social Security.

  • Description of the job: Details of functions, requirements and level of qualification required.

  • Accreditation of the company's financial solvency: Proof that you have sufficient means to undertake the contract.

  • Applicant's CV and supporting documentation of his academic qualifications or equivalent professional experience.

  • Complete worker's passport.

  • Proof of payment of the administrative fee (model 790, code 038).

Term and effects of the procedure

  • The resolution period is 45 days business days from the day following receipt of the application.

  • If it is not resolved within that time, it is considered denied due to administrative silence.

  • If the resolution is favorable, the company must register the worker with Social Security immediately.
