EU Family Card

The Residence Card for Family Members of European Union Citizens allows family members of EU citizens to legally reside in Spain. This right is based on European and Spanish regulations that guarantee the free movement and residence of EU citizens and their family members.

Who can apply?

Family members who have a legal or accredited relationship with a citizen of the European Union, the European Economic Area, or Switzerland and who will accompany or join them in Spain may apply for this card. Those eligible for this authorization fall into two categories, depending on whether the EU citizen is a student or not.

Who can benefit from this authorization?

  • Spouse, provided there has been no annulment, divorce or legal separation.

  • Registered couple in a public register of an EU or EEA Member State where registration is still valid. Registered partnerships and marriage are not permitted at the same time.

  • Children of the citizen or his or her spouse or registered partner, under 21 years of age, financially dependent adults, or people with disabilities.

  • Other family that:

    • They are the responsibility of the EU citizen in their country of origin.

    • Lived with him in his country of origin for at least 24 consecutive months, duly accredited.

    • Require personal care for serious health or disability reasons.

  • Unregistered common-law couple, provided that a credit is provided stable relationship:

    • Continuous marital cohabitation of at least one year, unless there are children in common, in which case it will be sufficient to prove stable cohabitation.

  • Spouse.

  • Registered couple officially established in an EU or EEA Member State.

  • Direct children of the EU citizen, his or her spouse or registered partner, under 21 years of age, seniors living in their care or people with disabilities.

  • Direct ancestors of the EU citizen, his or her spouse or registered partner, provided that they are dependent on him or her.

  • Other family members that:

    • They are in your care in the country of origin.

    • They lived with him for at least 24 consecutive months, duly accredited.

    • Require personal care for serious health or disability reasons.

  • Unregistered domestic partnership, when a stable relationship can be demonstrated:

    • Coexistence of at least an uninterrupted year,

    • Stable cohabitation if there are children in common.

Request for authorization from the employer

In order for a family member to obtain the Residence Card as a Family Member of an EU Citizen, it is essential that EU citizens meet certain conditions. Specifically, they must reside in Spain for a period of more than three months and be in one of the following situations:

The EU citizen must:

  • Accompany or be in the process of reunification with the requesting family member.

  • Have the right of residence in Spain for more than three months, whether as a worker, student or person with their own financial means.

Additionally, you must meet one of these three conditions:

1. Be an employee in Spain

Be registered with Social Security as a salaried employee.

2. Be self-employed in Spain

Carry out a professional or economic activity as a legally established self-employed person.

3. Have sufficient financial means

Have your own financial resources to support yourself and your family, without resorting to social assistance from the Spanish State, and also:

  • Dispose of health insurance public or private that provides coverage equivalent to the National Health System.

  • Financial sufficiency will be assessed on an individual basis, but as a reference, having sufficient income is considered sufficient. above the annual threshold set by the General State Budget to receive a non-contributory pension.

4. Be a student enrolled in a recognized center

Be enrolled in an authorized educational center in Spain (public or private) to pursue studies or vocational training, and also:

  • Having a public or private health insurance that covers the entire stay in Spain.

  • make a responsible statement Proving that they have sufficient financial resources to support themselves and their family members without depending on the Spanish social assistance system.
