What is the initial authorization for temporary residence and self-employment?

The initial authorization for temporary residence and self-employment allows foreigners over 18 years of age to legally reside in Spain for a period of more than 90 days and less than 5 years to engage in a lucrative economic activity as self-employed individuals.

This permit is designed for those who wish to start a business or practice a profession independently, without needing an employer. 

It is the employer in Spain who submits the application to the Immigration Office .

This authorization has a duration equivalent to the contract offered, with an initial maximum of one year. In addition, it is limited to a specific occupation and even regional territorial scope, except in those cases where the national employment situation does not apply.

Duration and geographical scope

The position must be listed in the catalog of hard-to-fill jobs or, failing that, provide documentary evidence that it has not been possible to fill the vacancy with available personnel on the domestic labor market.

  • It is limited to a autonomous geographic area (that is, within a specific Autonomous Community).

  • It is also restricted to a specific sector of activity.

If the Autonomous Community has delegated powers in this area, it may establish the exact geographical scope of application of the authorization within its territory.

Requirements for obtaining the initial authorization for temporary residence and employment in Spain

  • Comply with the legal requirements for nationals to carry out the activity (licenses, registrations, municipal permits, etc.).

  • Provide proof of sufficient qualifications or experience, in addition to membership if legally required for the profession.

  • Demonstrate that you have sufficient investment to start the business or activity, including its potential impact on job creation, even if it is self-employment.

  • Not having assumed a commitment of no return after a prior voluntary departure from Spain.

  • Not represent a risk to public order, safety or public health, which will be verified by criminal record certificates and a police report.

  • Pay the corresponding administrative fee.

Documentation required for the initial application for temporary residence and employment authorization.

  1. Applicants from outside Spain must submit their visa application to the Spanish consulate in their country of origin or legal residence.

  2. The Immigration Office will automatically collect criminal and security records reports, which must be issued within 7 days.

  3. If the requirements are not met, or if false documents or bad faith are detected, the application will be rejected. denied.

  4. The resolution must be notified within a maximum period of three months from the moment the consulate communicates the request. If there is no response within this period, it is understood dismissed due to administrative silence.

  5. If the resolution is favorable, the authorization is recorded in the system and remains conditioned a:

    • The issuance of the visa.

    • La legal entry into Spain.

    • El High social security within three months of entry.

  6. Within one month since discharge, the request must be made Foreigner Identity Card (TIE).

  7. If registration with Social Security is not completed within those three months, the foreigner must leave the country or will remain in an irregular situation.

Important: If the project includes activity in multiple Autonomous Communities from the first year, an additional authorization must be requested in each of them.
