Family roots in Spain

If you are a foreigner and have direct family ties to Spanish citizens or minors in your care, you can obtain legal residency through family roots.

What is family roots in Spain?

Family roots are a temporary residence permit for exceptional circumstances granted to foreigners who have a direct relationship with a minor who is a national of a country in the European Union, the European Economic Area, or Switzerland.

It applies mainly to the parents of minors with Spanish or EU nationality, provided that the applicant lives with the minor and is under his or her care.

Who can apply for family roots?

Anyone can apply for family roots. father, mother or legal guardian of a minor who is a national of a Member State of the EU, the EEA or Switzerland, provided that it meets the following requirements:

  • Reside in Spain at the time of application.

  • Having the minor in your care.

  • Living with him or, failing that, fulfill their parental obligations (for example, keeping up to date with child support payments or maintaining regular contact).

This authorization can also be requested by anyone provide support to a person with a disability, a national of the EU, EEA or Switzerland, for the exercise of his legal capacity, provided that:

Requirements for applying for family roots in Spain

  • Not being an EU citizen or a family member to whom the EU regime applies.

  • Have no criminal record in Spain or in any other country where you have resided in the last 5 years.

  • Not being subject to a non-return commitment following a voluntary return program.

  • Be the father, mother, or guardian of a minor, a national of another Member State of the European Union, the European Economic Area, or Switzerland, provided that when applying, you prove that you reside in Spain, are in charge of the minor and live with them, or are up to date with your parental obligations.

  • To provide support to a person with a disability who is a national of another Member State of the European Union, the European Economic Area, or Switzerland, in exercising their legal capacity, provided that the applicant is a family member, is in charge of the person with a disability, and lives with them.

  • Pay the fee.
