What is social and labor roots in Spain?

Socio-laboral roots are a form of temporary residence due to exceptional circumstances aimed at foreigners who have remained in Spain continuously for at least two years and can demonstrate a valid employment relationship.

Who can apply for social and labor roots?

Requirements for applying for social roots in Spain

  • Be in Spain at the time of application

  • Have no criminal record in Spain or in any other country where you have resided in the last 5 years.

  • Not be prohibited from entering Spain or listed as inadmissible to the Schengen area

  • Not being subject to a non-return commitment following a voluntary return program.

  • Have lived continuously in Spain for at least 2 years.

  • Not pose a risk to public order or security

  • Payment of the administrative fee

  • Guaranteed minimum wage

  • Employment contracts must guarantee at least one of the following salary conditions:

    • The current Interprofessional Minimum Wage (SMI), or
    • The salary provided for in the applicable collective agreement, proportional to the agreed working hours.

 

  • Minimum working day and duration: lThe sum of the contracts must reach, as a minimum, a weekly work day of 20 hours, calculated in global computation.

  • Possibility of submitting multiple contracts. Multiple contracts may be submitted provided that:

    • Whether it is seasonal or part-time work, with successive contracts from different employers.

    • Part-time and simultaneous work is carried out for several employers, which together meet the required minimum working hours..

  • Employer Requirements: Employers must comply with the provisions of Article 74 of the Immigration Regulations, with the exception of point 1.a). This means they must have the legal capacity to enter into contracts, be up to date with their tax obligations, and demonstrate the viability of their business activity.
